# Terms of Service — Sorasaki Hina Bot

Please read these Terms of Service ("Terms") carefully before using the Sorasaki Hina Discord bot ("the Bot," "we," "us"). By inviting the Bot to a server or interacting with it, you agree to be bound by these Terms. If you do not agree, do not use the Bot.

## 1. Description of Service

The Bot provides the following features to Discord servers it is added to:
- Music playback (`/play`, `/pause`, `/skip`, `/queue`, etc.) via SoundCloud and Lavalink audio streaming.
- An AI chat assistant powered by Groq's API (running open-weight AI models), invoked by mentioning the Bot or the word "Hina," including text summarization (`/summarize`) and image analysis.
- Server moderation tools (`/mod warn`, `/mod timeout`, `/mod kick`, `/mod ban`) usable only by members with the corresponding Discord permissions.
- An AutoMod system (`/automod`) that automatically detects rule-breaking messages (banned words, spam, mention spam) and can log warnings or take automatic action.
- Owner-configurable automatic punishment (`/automod warnpunish`): the server owner can set a warning threshold after which a member is automatically timed out, kicked, or banned.
- Utility features: reminders (`/remind`), server/user info lookups, and casual game features (`/gacha`, `/work`).

## 2. Eligibility

You must meet [Discord's minimum age requirement](https://discord.com/terms) (13 years old, or higher where required by local law) to use the Bot. Use of the Bot is also subject to Discord's own Terms of Service and Community Guidelines.

## 3. Acceptable Use

You agree not to:
- Use the Bot to harass, abuse, threaten, or harm other users.
- Attempt to exploit, reverse-engineer, spam, or overload the Bot's commands or infrastructure.
- Use the AI chat feature to generate illegal content, content that violates Discord's Community Guidelines, or content involving minors in any inappropriate context.
- Use the moderation or AutoMod commands to abuse server members outside the scope of legitimate moderation.
- Use the Bot in any way that violates applicable law.

Violation of these Terms may result in the Bot refusing to respond to you, or being removed from a server at our discretion.

## 4. AI-Generated Content Disclaimer

Responses generated via the AI chat feature (powered by Groq, using open-weight AI models) are produced by a third-party AI model and are provided "as is." AI responses:
- May be inaccurate, incomplete, or inappropriate in some cases.
- Do not represent factual, legal, medical, financial, or professional advice.
- Should not be relied upon for decisions with real-world consequences without independent verification.

We are not responsible for actions taken based on AI-generated content.

## 5. Moderation & AutoMod Disclaimer

The Bot's moderation commands (`/mod warn`, `/mod timeout`, `/mod kick`, `/mod ban`) execute actions **on behalf of, and at the direction of, server moderators/administrators** who invoke them. We are not responsible for how server staff use these tools.

The Bot's AutoMod system, and any automatic punishment configured through `/automod warnpunish` (auto-timeout, auto-kick, or auto-ban after a set number of warnings), is **configured entirely by the server owner or staff with Manage Server permission**, and is applied automatically without manual case-by-case review. Server owners are solely responsible for the thresholds and punishments they configure, and for ensuring their staff use these tools appropriately and in accordance with Discord's Terms of Service.

## 6. Third-Party Content

Music playback relies on third-party services (SoundCloud, Lavalink nodes). We do not own or control this content and are not responsible for its availability, accuracy, or appropriateness. Copyrighted content played through the Bot remains the responsibility of the user who requested it and the platform it was sourced from.

## 7. Availability

The Bot is provided on an "as available" basis. We do not guarantee uninterrupted uptime, and features (including music playback, AI chat, AutoMod, and reminders) may be delayed, unavailable, or discontinued at any time without notice, including due to third-party service outages (e.g., Groq, Lavalink nodes, SoundCloud).

## 8. Limitation of Liability

To the maximum extent permitted by law, the Bot's operators are not liable for any indirect, incidental, or consequential damages arising from your use of the Bot, including but not limited to data loss, moderation or AutoMod actions taken by or configured by server staff, or reliance on AI-generated content.

## 9. Termination

We reserve the right to restrict or terminate access to the Bot, for any user or server, at our discretion, particularly in cases of abuse, violation of these Terms, or violation of Discord's Terms of Service.

## 10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Bot after changes constitutes acceptance of the revised Terms.
